Executive Fighter Terms and Conditions

Executive Fighter Events Pty Ltd ACN 674 448 634  (‘we’ and ‘us’) are committed to protecting the rights and safety of our patrons and customers and so, the following terms and conditions apply to all patrons, customers, ticket-purchasers, attendees, and any individual or entity that engage with us, or our related entities, directly or indirectly. The following terms and conditions also govern the conditions of entry into our Venue(s) as well as the purchase and refund of tickets to any Event hosted by us. We refer to patrons, customers, ticket-purchasers, attendees or any individual or entity that engages with us as “you” and “your. Any references to “the r”, “the Company”, “we” and “us” refer to Executive Fighter Events Pty Ltd. 

Conditions of entry and membership

  1. We reserve our right to refuse entry to, or request you to leave the Venue if you; 

 

    a) Are or reasonably appear to be intoxicated or under the influence of illicit substances 

​

    b) Engage in conduct which unreasonably interferes with another person; 

​

    c) Behave in an inappropriate or derogatory manner towards staff, members or another person; 

​

    d) Behave unlawfully, in a disorderly fashion and/or in an offensive manner towards staff, members or  another person; 

​

     e) Are deemed to be inappropriately dressed for a Black-tie event; 

​

    f) Attend an Event for which you have not registered nor purchased tickets for; 

​

    g) Refuse to comply with reasonable requests from staff members and/or promoters; 

​

    h) Directly or indirectly breach any laws, by-laws, orders or other rules applicable to Venue or the Event; 

 

Directly or indirectly breach any term or condition contained herein

 

   2. If you fail to leave the Venue after being requested to do so, we may call and make a formal report to authorities and any license and or membership you hold with us may be revoked.  

 

   3. We reserve the right to refuse entry and/or registration to individuals or entities deemed to be competitors, partners and/or sponsors of a same or similar Event.

  4. We reserve the right to refuse entry and/or registration to individuals if an objection to their entry is raised by any Event Sponsor and/or Partner. 

​

  5. We reserve the right to refuse entry and/ or registration to individuals inappropriately addressed for an Event. 

 

  6. Patrons may not wear or display commercial, political, religious or offensive signage or logos, sell any goods within the Venue or give away political, religious, advertising or promotional materials without our prior written consent. 

 

  7. Patrons must display their tickets upon entry into the Venue. If the ticket is damaged or defaced, OR does not appear to be purchased from a licensed agent, then we may refuse entry into the venue. 

 

  8. Patrons with tickets purchased at a concessional price must have available on entry into the venue  proof of age or other documents evidencing such concession entitlement.

 

  9. We reserve our right to inspect and/or search patrons attending an event, as well as any possessions (ie. Purse or wallet), at the time of entry into the Venue. If you refuse an inspection or search, you may be denied entry into the Venue. 

 

  10. Alcoholic beverages must not be taken into or out of the Venue and you must produce ID to bar staff upon their request, upon the purchase of alcohol.

  11. You are not permitted to bring food or beverages into the Venue unless this is a dietary or medical  requirement. 

​

  12. Smoking (including electronic cigarettes and vapes) is strictly prohibited in all areas in the Venue. The Venue has a strict no smoking policy and any patron smoking in the Venue will be asked to leave immediately. 

​

  13. Cameras, audio and video records may be brought into the venue however, you are not permitted to sell any recordings of a match without our prior written consent.  

​

  14. Prams, pushers, bags and other belongings may be brought into the venue but must be able to fit     under the patron’s seat. Umbrellas are permitted in the venue but must not be opened or raised in the  seating areas at any time.

​

  15. If venue management deem that any item has the potential to cause injury, nuisance or inconvenience to any other person, such item will not be permitted into the venue. Items not permitted into the venue include but are not limited to  controlled, dangerous or illegal substances, hailers, whistles, weapons of any description, poles, flags and/or signs. 

 

SOCIAL MEDIA AND PHOTOGRAPHS

   16. You acknowledge and authorise us, the Venue and/or any promoter to use any photo, image, audio or video recording of you, taken at an event or match. You authorise us to use these photos for advertising and marketing purposes OR as may be required by law.

CANCELLATION POLICY / DISCLAIMER

  17. Ticket-purchasers can request a refund of their ticket at least 14 days prior to the Event after which time, ticket-purchasers are not entitled to an exchange or refund unless otherwise required by law. If a refund is done via EFT, then a percentage surcharge will apply. 

​

  18. If the Event is cancelled or postponed for any reason, neither the Planner, Venue nor any of its agents will be liable for any costs you have incurred in relation to your planned attendance at the Event, including travel and accommodation costs. 

 

  19. The Event may be rescheduled to another date if necessary, at a time determined by us to fighter unavailability, injury or illness, adverse weather or other adverse conditions Ticket-purchasers will be notified of any such rescheduling. In this case, your ticket will be valid for the rescheduled date and you will not be entitled to a refund.

 

  20. We will not be liable for failure or delay to perform obligations under these Terms and Conditions where it has become practically impossible to do so as a result of circumstances beyond our control including, but not limited to any Force Majeure Event or change forced on a party by a government directive, regulation or law .

  21. A Force Majeure Event includes, but is not limited to natural disaster, covid-19 outbreaks, pandemics, acts of God, terrorism, war, diseases, new law or order, quarantines, flooding, fire, national, regional or local emergencies or any other unforeseen event beyond our control.

NO LIABILITY

You assume all risk of any damage or loss (including property damage, injury, monetary and consequential loss) however so it may arise within the Venue. All and any items brought into the premises are brought at your own risk and we are not responsible for any loss, theft or damage to any personal property.

 

PRIVACY

By accepting and/or agreeing to our terms and conditions, you consent to EXECUTIVE FIGHTER PROMOTIONS PTY LTD (hereinafter ‘the Company’), and it’s related and/or associated entities including its, partner and sponsors collecting, using, gathering, disclosing, investigating personal information about you as may be required in the Ordinary course of business and, in accordance with the Company’s Privacy Policy. The Company will take all reasonable steps to abide by the Privacy Policy and all Users hereby agree to its terms and agree to act in accordance with the policy when using this website. If you do not agree to the collection of this information and the other information specified in the Privacy Policy, then do not accept the terms and conditions of this Agreement when registering for the Auction Service and/or do not use the website.

By accepting the terms of this Agreement, you consent to the following:

(A) collection of personal information including your name, residential address, date of birth, telephone numbers, email addresses and fax addresses; in some cases, credit card details; bidding and buying activity in connection with the Auction Service; and your use of the website generally;

(B) use of the above personal information for certain purposes specified in greater detail in the Privacy Policy, including without limitation for internal use for improving the Auction Service, meeting the Company’s legal obligations, statistical analysis of usage of the website and administrative purposes connected with the website; and

(C) the Company’s disclosure of your information in certain circumstances as specified in the Privacy Policy, including without limitation, subject to applicable law.

It is paramount that we manage your Personal Information securely and in accordance with the relevant legislation, principles and codes including; 

  1. Privacy Act 1988 (Cth);

  2. Australian Privacy Principles (APP); and 

  3. Privacy (Credit Reporting) Code 2014 (Cth).

This policy does not limit our rights and obligations under Privacy Laws. 

By interacting, communicating or dealing with the Company (including through over the phone, text, email, social media or through our website) you agree that the Company can use Personal Information about you in accordance with this policy. If you provide Personal Information about a business, organisation or individuals other than yourself, you warrant that you have obtained their consent to disclose such information.

This policy is not limited to existing customers, associates of customers or guarantors. It extends to all other individuals who deal with the Company, directly or indirectly, whether in relation to the provision of our services or otherwise.

The Company may also collect, use and share your information in other ways where you have authorised us to do so or where permitted or compelled to do so by law.

The Company may also collect information about your activity on our website and for Cookies.

The Company takes appropriate measures to secure your information and to protect it against unauthorised or unlawful access, unpermitted use or interference. The Company implements a number of safeguards, including, but not limited to; 

  • Ongoing staff education and training 

  • Anti-virus software

  • Taking precautions with invoicing 

  • Taking precautions with respect to fraud and system security

All the Company’s records are stored electronically on our customized software systems and via offsite trusted third parties.

​

The information supplied on registration or at the Event will be shared and used by the Promoter and partners/sponsors of the Event. Unless you advise the Promoter otherwise, your name and contact details will be included in the list of event participants distributed to partners/sponsors of the Event.

By registering for this Event, you are automatically subscribed to our database. If you wish to be removed from this database, please let us know in writing and we’ll have you removed immediately. You are also welcomed to unsubscribe at any time in the future by notifying the Promoter or our partners/sponsors from whom you receive communications.

BOOKING PROCEDURE 

You agree to provide accurate and honest information when completing the booking procedure through our website. When a request in made through our website for the purchase of ticket(s), you shall be deemed to accept our terms and conditions and a booking confirmation will be issued by email with a corresponding invoice(s) payable by the due date stated on the invoice.  

​

PAYMENT BY INVOICE

Where payment is not made by the due date, the Promoter reserves the right to charge additional default interest of 15% per annum (accruing daily) from the applicable due date until the date of actual payment. 

 

FUNDRAISING & AUCTION 

Auctions, raffles and memorabilia will be outsourced and subject to the auctioneers Terms & Conditions.
 

PERSONAL GUARANTEE

Where the ticket purchaser is a limited liability Company/entity, its directors and shareholders accept personal liability for payment of all the fees and surcharges.

CATERING 

Food or beverages purchased at commercial outlets outside the venue’s licensed are not generally not permitted however the Licensor and Promoter maintain discretion. Attendees will generally be directed to dispose of such products or have such products confiscated prior to being permitted into the venue. This does not apply to food or beverages for attendees with special dietary requirements. Deliveries into the venue from external caterers are not permitted. Our Events are fully catered in accordance with the licence of the particular Venue of the Event. Please contact the Venue owner or manager to confirm the terms and conditions of the relevant catering for the particular Event you are attending.  

 

CUSTOMER OBLIGATIONS

You agree to (as applicable):

  1. Pay all monies due and owing when specified

  2. Pay interest at 15% per annum calculated on a daily basis on all sums unpaid from the due date for payment until payment is received by the us; 

  3. Pay to the us any costs incurred by us in recovering sums owed hereunder or damages for non-performance hereof including legal costs and disbursements on a full indemnity basis;

  4. Not bring any cameras, food or alcoholic beverages to the Event and further agree that alcoholic beverages may be consumed only as directed by the us,; 

 

  1. Comply with the non-smoking restrictions at the venue;

  2. Comply with the requirements of the venue owner/manager, any competent local or statutory authority or with the laws or other rules and regulations of any other relevant authority;

  3. Not damage the Venue or any part of it nor any property of another person (or its licensors, contractors);

Accompany any children under the age of 18 who attend the event with you.
